KeyTiler Terms of Service

These Terms of Service (“Terms”) govern your access to and use of KeyTiler, including the KeyTiler website, software releases, update services, and related materials.

KeyTiler is provided by Qiu Yu Zhou (“KeyTiler”, “we”, “us”, or “our”).

By downloading, installing, accessing, or using KeyTiler, you agree to these Terms and to any additional license terms that apply to the specific release you use.

If you do not agree to these Terms, do not download, install, or use KeyTiler.

1. KeyTiler Releases

KeyTiler may be made available in different release stages.

Preview Releases

Preview Releases are pre-1.0 versions of KeyTiler made available for product validation, testing, and early use.

Preview Releases are currently provided without charge and are subject to the separate KeyTiler Preview License.

Stable Releases

Stable Releases begin with version 1.0 or another release expressly identified by KeyTiler as a Stable Release.

Stable Releases may be offered on paid or otherwise commercial terms and may be subject to a separate Stable License, End User License Agreement, purchase terms, or other applicable commercial terms.

The availability of a Preview Release does not create any right to receive a Stable Release without charge.

2. Applicable Software License

Your right to install and run a KeyTiler software release is governed by the license that applies to that release.

For Preview Releases, the KeyTiler Preview License applies.

Future Stable Releases may be governed by separate license terms published before or at the time those releases become available.

If a release-specific license conflicts with these Terms regarding the licensing, availability, expiration, or permitted use of that particular release, the release-specific license controls for that issue.

These Terms continue to govern general matters that are not specifically addressed by the applicable release license.

3. Official Distribution

KeyTiler software should be obtained only through distribution channels identified by KeyTiler as official.

Depending on the release, these channels may include the official KeyTiler website, an application marketplace, or another distribution method expressly identified by KeyTiler.

The availability of KeyTiler through one distribution channel does not create a commitment to make the software available through another channel.

Different distribution channels may be subject to additional terms imposed by the relevant platform or distributor.

4. macOS Permissions and System Access

Some KeyTiler functionality requires macOS permissions that allow KeyTiler to perform user-requested window-management actions.

You are responsible for deciding whether to grant those permissions through macOS.

Granting a system permission does not transfer ownership or general control of your Mac to KeyTiler.

Available functionality may be limited if required permissions are not granted, are later revoked, or are restricted by macOS.

5. Updates and Product Changes

KeyTiler may be updated, modified, replaced, or discontinued as the product develops.

Updates may change functionality, compatibility, system requirements, user interface, distribution methods, or other product behavior.

Unless expressly stated in the applicable release license or purchase terms, downloading or using one KeyTiler release does not create a contractual right to:

  • receive any particular future feature;
  • receive updates indefinitely;
  • maintain compatibility with every future macOS version;
  • maintain compatibility with every Mac configuration;
  • receive a specific release on a particular schedule; or
  • receive future paid releases without charge.

6. Acceptable Use

You may use KeyTiler only in accordance with these Terms, the applicable software license, and applicable law.

You may not use KeyTiler to:

  • violate applicable law or the rights of another person;
  • interfere with the security, integrity, or operation of KeyTiler or its distribution infrastructure;
  • impersonate KeyTiler or misrepresent an unofficial or modified copy as an official KeyTiler release;
  • circumvent technical restrictions in violation of the applicable software license; or
  • distribute KeyTiler except where distribution is expressly permitted by the applicable license or by us.

Nothing in these Terms restricts rights that cannot lawfully be restricted.

7. Intellectual Property

KeyTiler, including its software, source code, executable code, name, branding, interface, documentation, website content, release materials, and other associated intellectual property, remains the property of Qiu Yu Zhou or the applicable licensors.

Downloading, purchasing, installing, or using KeyTiler does not transfer ownership of KeyTiler or its intellectual property to you.

You receive only the limited rights expressly granted by these Terms and the license applicable to the release you use.

8. Third-Party Platforms and Services

KeyTiler operates in an environment provided by macOS and may depend on operating-system behavior, APIs, permissions, security policies, or services controlled by Apple or other third parties.

Changes made by those third parties may affect KeyTiler’s availability, compatibility, or functionality.

We do not control those third-party platforms and cannot guarantee that their behavior will remain unchanged.

9. Availability and Support

KeyTiler may not be available continuously or work with every hardware, software, or system configuration.

Unless separately promised in writing, use of KeyTiler does not include a guaranteed support response time, guaranteed maintenance period, or guaranteed availability level.

Nothing in these Terms prevents us from providing support, updates, maintenance, or other assistance voluntarily.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, KeyTiler is provided on an “as is” and “as available” basis.

No warranty is made that KeyTiler will be uninterrupted, error-free, compatible with every system configuration, or suitable for every particular purpose.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

Nothing in these Terms excludes any warranty, guarantee, or consumer right that cannot legally be excluded.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Qiu Yu Zhou and any providers involved in making KeyTiler available will not be liable for indirect, incidental, special, consequential, or similar losses arising from or relating to your use of, inability to use, or reliance on KeyTiler.

This may include, where permitted by law, loss of data, loss of business, loss of profits, loss of productivity, or interruption of operations.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

12. Suspension or Termination of Rights

Your rights under a KeyTiler software license may end if you materially violate these Terms or the applicable release license.

Termination does not transfer ownership of the software to you and does not remove restrictions that by their nature continue after termination, including intellectual-property restrictions.

The expiration of a Preview Release under the Preview License is a product lifecycle event and is not, by itself, a termination for misconduct.

13. Privacy

KeyTiler’s handling of personal information in the website context, if any, is described separately in the Website Privacy Notice.

The Website Privacy Notice is not replaced by these Terms.

14. Changes to These Terms

These Terms may be updated as KeyTiler develops, including to reflect changes to the product, distribution model, commercial structure, or applicable legal requirements.

The current version will be published on the official KeyTiler website together with its last-updated date.

Changes to these Terms do not retroactively create a payment obligation for a Preview Release that was provided without charge.

Where applicable law requires additional notice or consent for a change, those requirements will be followed.
